ngenge Terms & Conditions

(1) General terms

1.1. Please ensure that you read the following legally binding agreement between NgengeSport SARL., under the brand name, ngenge.cd, and yourself. It is your sole responsibility to ensure that you fully understand the contents of this agreement.

1.2. Upon signup you will be prompted with the option to accept that you agree with these terms and conditions. By selecting this, you acknowledge that you have read and agree to be bound by the terms and conditions of this agreement and the privacy policy set out here.

1.3. These terms and conditions apply to all customers who use any of the products, applications or websites offered by ngenge, or register an account with us. If you have any questions about these terms, you should contact customer support before proceeding. If you do not agree to any of these terms, you should not make use of our services.

1.4. We may need to amend these terms from time to time, for more information please see section 13 below.

1.5. To use our services, you must create a real account and deposit or make use of any no deposit bonus offers available to you at the time of creating an account.

1.7. The website is operated and managed by NGENGESPORT S.A.R.L., a company bearing registration number 01-84-N33781Y, and having its registered address at Kinshasa, DR Congo

NgengeSport SARL is licenced and regulated by the Government of Democratic Republic of Congo with license.

1.8. We do not intend for anyone to use our services where such use is illegal. The availability of the website does not constitute an offer or invitation by us to use the website in any place in where such use is illegal.

1.9. Some legal jurisdictions do not have specific regulations surrounding the legality of online gambling. In other legal jurisdictions there are laws that pertain specifically to this legality. We make no representation or warranty with respect to the legality or otherwise of the access to and use of our services, and the making of deposits to us and receipt of any winnings from us, under any applicable laws. You accept sole responsibility for determining whether your use of the online casino/sportsbook is legal under any applicable laws in your jurisdiction. If you are aware that your use of our services is not deemed to be legal in your jurisdiction, you are not authorized to use your payment card or alternative payment method to complete any transaction.

1.10. Furthermore, you may under no circumstance make use of our services if you are under 18 years of age or the legal age in your jurisdiction. It is your sole responsibility to be aware if you are of the legal age as determined by applicable laws in your jurisdiction.

1.11. We do not offer our services to residents from following country or territory:

Aruba, Australia, Bonaire, Curacao, China, Estonia, France & outlying territories, Hong Kong SAR, Malaysia, Netherlands, Northern Ireland, Russian Federation, Saba, Slovakia, Sint Eustatius, St. Martin, Sweden, Spain, Turkey, United Kingdom of Great Britain, Ukraine, USA & outlying territories.

1.12. If we suspect any unlawful, fraudulent or improper activity, we reserve the right to inform any relevant authority, other online sportsbook/casino operator, bank, credit card company, electronic payment providers or any other concerned party of your identity as well as any suspected activity.

(2) Definitions

2.1. For the purposes of this agreement the following phrases shall have the meanings attached as described below, unless specifically otherwise stated or if it is clear from the context that they should mean something else.

2.2. “We, us, ours” is ngenge.cd.

2.3. “You, your, yours or player/s” is yourself or any or any other person that reads these terms and conditions and makes use of our services in any way.

2.4. “Account” is a real account opened by you on the website.

2.5. “Games” are sports, casino, live casino, jackpot games, virtual sports, poker, and any other service that may become available at a later stage by means of us adding it to the website.

2.6. “T&C’s, terms” are these terms and conditions.

2.7. “The website, platform, services” is the website available at ngenge.cd or any other subdomain.

2.8. “Customer support” is anyone working at ngenge that has the authority to handle queries from our players.

2.9. “Payment provider” is any third-party payment processing company dealing with the processing of deposits and withdrawals.

(3) Your account

3.1. If you wish to make use of any of our services in any way you must register a real account and deposit.

3.2. In order to successfully register a real account, you will need to complete the sign-up procedure. During this procedure, you are required to enter all relevant details and information requested into the allocated spaces. This information includes but is not limited to:

First and last name, email address, residential address, chosen currency etc. We reserve the right to refuse any account to register on our platform.

3.3. We take your account security very seriously. When you register your account, you will be asked to provide a username, email address as well as a password. When accessing your account in future, you will be asked to enter a combination of username/email address as well as your chosen password to enter the website. It is your sole responsibility to ensure that your password and credentials are kept safe, secure, and confidential. Please never disclose your account credentials or password to anyone. Every person that enters the correct username/email and password combination is considered to be you. We take no responsibility for third party access to your account and shall not be held liable for any misuse as a result of unauthorized access to your account. If you suspect your account has been tampered with, please notify customer support immediately. Conversely, you may not use any other username/email address and password to enter our website if you are not the owner of the account.

3.4. We make use of advanced encryption methods to keep your information safe and secure. If you are found attempting to circumvent these security methods on our software, we will be entitled to terminate, with immediate effect, your access to our website and/or have your account blocked. We, furthermore, reserve the right to inform the relevant authorities.

3.5. It is your sole responsibility to ensure that all of your personal details are up to date at all times. If there are any changes to your physical address, personal information, contact information or any other information provided on your account please contact our customer support team and ask them to have these details amended if you are not able to do so yourself.

3.6. You may be asked to provide further verification documentation to prove that the amendments you are asking for are true and valid. Please refer to section 7 below for more information about verification.

3.7. You are only allowed one singe real account with ngenge. If you open, or attempt to open more than one account, for whatever reason, we reserve the right to block and/or close any or all of your accounts at our discretion. Should we decide to leave one account open it will be the first account that you opened with us and we will decide based on the nature and extent of the situation what course of action to take with the remaining balances on the accounts which are in contravention of this rule. We make use of multiple forms of detecting this behaviour and if we suspect that you have attempted to create more than one account and we have blocked or closed any or all of the accounts, it is your sole responsibility to provide evidence to the contrary.

3.8. You are not eligible to open an account if you are: an employee of ngenge, one of its licensees, distributors, agencies, partners, retailers, or members of immediate family.

3.9. We will only use your personal information in accordance with our privacy policy, which is set out in full here. We reserve the right to amend the privacy policy at any time. We may also ask you to provide us with additional details and any such additional information will also be kept confidential in accordance with our privacy policy.

3.10. You may choose to close your account at any time. If you have any active withdrawals, these will be processed accordingly. Furthermore, any pending bets will be settled into your balance as per the settlement result and if you have an active bonus or active funds, these will remain in the account unless otherwise specified by you. If you wish to have the account re-opened, you will need to request this through our customer support, and they will ensure that any necessary investigation is carried out. If there have been any financial transactions made on the account, we are obliged to keep account information on our system to comply with our anti money laundry and audit policies.

3.11. ngenge will consider an account to be inactive after a period of 12 months after the last successful login.

3.12. ngenge will contact you should your account become inactive. If after being contacted, your account remains inactive, ngenge reserves the right to charge an administration fee on any remaining balance on the account.

3.13. The administration fee will be calculated as 10% of the remaining balance at the time of the first deduction and will be charged in 10 equal instalments until the balance is zero. Once the balance has reached zero, no further fees will be charged. If You start to play on your account again once the fees have started being charged, and it is within 6 months of the start of the fees being deducted, you can request to recover any funds that have been paid as fees in that time.

3.14. If you have started play within 6 months of the first deduction or your account is locked, blocked, or excluded, you would need to contact customer support to request the appropriate action.

(4) Your responsibilities

4.1. You are solely responsible to determine whether the access and use of the website by you, and the making of deposits and receipt of winnings, is permitted under any applicable laws.

4.2. It is your responsibility to ensure that you understand the rules and procedures of the games on the website and your use of online gaming in general, before you play any such games.

4.3 You shall not be allowed to transfer, in any way whatsoever, your rights under this agreement, without our prior written consent, which may only be given at our sole discretion.

4.4. You are fully responsible for all taxes, fees, and other costs incidental to and arising from any winnings resulting from use of our services. You will indemnify and reimburse us for any costs, expenses or losses that may be caused to us as a result of any claim or demand made by any governmental or other authority, with regard to tax withholding obligations or similar obligations to which we may be subject in connection with processing your withdrawal requests.

4.5. You agree that you will use the website and your account solely for the purpose of participating in our entertainment offering and that you will not be using it for any financial activity or other such operation. Participating in the games will be strictly in your capacity as an individual for recreation and not in a professional capacity.

4.6. You acknowledge and understand that separate terms and conditions exist with respect to promotions, bonuses and special offers, and are meant to be used in addition to this agreement. These terms and conditions are set forth in further detail here or will be delivered to you personally per promotion. In the event of a conflict between the provisions of such promotions, bonuses and special offers, and the provisions of this agreement, the provisions of such promotions, bonuses and special offers will prevail.

4.7. For the removal of doubt, it is clarified that any use by you of the services of a payment provider will be subject to the terms and conditions of use prescribed by such payment provider. This, however, will not derogate from your obligations to us under this agreement.

4.8. You are solely responsible for the supply and maintenance of all of the computer equipment and telecommunications networks and internet access services that you need to use in order to access our services. We will not be liable in any way whatsoever for any losses caused to you by the internet or any telecommunication service provider which you have engaged in order to access our website.

4.9. You acknowledge that our random number generator will determine the outcome of the games played on our website and you accept the outcomes of all such games. You further agree that in the unlikely event of a disagreement between the result that appears on the software and the game server, the result that appears on the game server will prevail, and you acknowledge and agree that our records will be the final authority in determining the terms and circumstances of your participation in any gaming activity and the results of this participation.

4.9. You will not commit any acts or engage in any conduct that is or that could be reasonably expected to be damaging to our reputation or to the reputation or any other related service providers.

4.10. It is highly likely that the content shared by you though our services may be found on external services as well. For example, on social media platforms. It is your sole responsibility to ensure you understand that these services are not bound to us, and that by using them you agree to their terms and additional policies.

4.11. You will fully indemnify, defend and hold us and our officers, directors, employees, agents, contractors and suppliers harmless from and against any and all losses, costs, expenses, claims, demands, liabilities and damages (including legal fees), however caused, that may arise as a result of or in connection with access and use of the website by yourself or by anyone else using your username and password; or breach by you of any of the terms and provisions of this agreement.

4.12. We reserve the right to change this agreement from time to time as set out in section 19 below. It is your responsibility to check from time to time and see whether there is an updated version in accordance with section 19 below. It is your responsibility to ensure that you, at all times, where possible, retain a copy of any transaction records, client policies or rules to review them wherever necessary.

(5) Your warranties and representations

You hereby warrant and represent to us that:

5.1. You are not a resident of any of the excluded territories specified above and you are not attempting to access or use the website from any of these territories . This list may be updated from time to time at our discretion and all countries we choose to exclude are done at our sole discretion.

5.2. You are acting on your own behalf.

5.3. You are not restricted by limited legal capacity.

5.4. You are not classified as a compulsive gambler.

5.5. All details which you give or have given in the process of registering with us are accurate and you will continue to update such details in the event of any changes.

5.6. You are fully aware of the fact that there is a risk of losing money through the use of our services.

5.7. You are not depositing funds originating from criminal and/or illegal and/or unauthorized activities.

5.8. You do not otherwise conduct criminal or unlawful activities and/or intend to utilize your account in connection with such activities.

5.9. You do not use or intend to use or intend to allow any other person to use your account for any prohibited or unlawful activity, including but not limited to fraud or money laundering, under any applicable law, including without limitation the laws in your jurisdiction and the laws that apply to us.

5.10. You are not colluding or attempting to collude, and you do not intend to participate, directly or indirectly, in any collusion scheme with any other player in the course of any game you play or will play on website.

5.11. You are not under the age of either 18; or the age at which gambling activities are legal under the law of the jurisdiction that applies to you, whichever is greater.

5.12. The debit/credit card details provided by you in the deposit process are those of the registered account holder and the card has not been reported as lost or stolen.

5.13. You are not one of our officers, directors, employees, consultants or agents or of one of our affiliated or subsidiary companies, or suppliers or vendors, and you are not a relative of any of them (for the purpose of this clause, the term "relative" means spouse, partner, parent, child or sibling). In the event that you breach this restriction, one of the actions that will be taken against you is that you will not be entitled to any of your winnings.

5.14. You have not previously held a player account with us which was suspended or terminated by us, and you have not in the past charged back any monies via any player account.

5.15. In opening the player account, you will not provide any information or make any statement to us which is untrue, false, incorrect, incomplete, or misleading.

(6) Financials

(6.1) Deposits

6.1.1. In order to make use of our services, you must first have successfully registered a real account and then you will need to successfully deposit into your account. You may only take part in any of our games if you have sufficient funds in your account.

6.1.2. We endeavour to make available to you a variety of available mechanisms to deposit. These methods are displayed in more detail on your account page under the deposit tab …here. This page will only be available once you have successfully registered an account on our website. Please note that while you may see an available method on this page, it is possible that you will not be able to make use of this method. There are multiple reasons for these limitations, and some include availability in certain regions, certain financial institutions blocking these transactions, specific blocks on payment methods etc.

6.1.3. The methods available to deposit include but are not limited to: credit/debit card, bank transfer, electronic wallets, cryptocurrency wallets etc. The details of the financial transaction method used must be the same as the details that you have provided on your account. If there is a discrepancy in these details, we reserve the right to suspend the account or any accounts where mismatching information appears. If your account has been suspended, please contact customer support for further information.

6.1.4. Each individual request made by you to add funds to your account will be deemed a valid authorization for us or for the payment provider. This request will, if successful, prompt us or the payment provider to transfer the amount specified in the request to your account. If we discover that there has been an intentional abuse or misuse of source of funding, we will take the appropriate measures to rectify this situation on the individual account.

6.1.5. You acknowledge that you may, from time to time, upon our request, be required to provide additional details in respect of the deposits made by you.

6.1.6. The fiat currency you selected upon sign-up or the first fiat currency you deposit with is the currency that will remain on your account for its duration. We are unable to change the fiat currency once it has been selected. You are, however, able to activate multiple wallets on your account to make use of both fiat and cryptocurrency interchangeably.

6.1.7. We are not a financial institution and as a result, we do not allow any customers to participate in any form of play on credit. Furthermore, any deposits made into your account are not due any interest.

6.1.8. We will be entitled to determine whether the funds that you have requested to be credited to your player account are available, upon receiving confirmation from the relevant payment provider in accordance with such payment provider's approval procedures for such transactions to be reconciled, final, completed and cleared. Only when your deposits are reconciled and cleared to our satisfaction by the relevant payment provider, will the player account be credited with the funds, unless stated otherwise.

6.1.9. You agree that all funds deposited onto your account are intended to be used solely for the purpose of playing on our website. We are entitled to determine minimum and maximum amounts to be deposited in a player account, at our discretion.

6.1.10. Deposits made to your ngenge account should be within a nominal range with regards to all gameplay. What this means is that your deposit amounts should be intended for play on our service at the rate at which they are made. If there is suspicion of abuse, we reserve the right to cancel any deposit, and/or any withdrawals that are related to this abuse and to take appropriate actions to recover funds or confiscate winnings generated from this activity. Furthermore, we reserve the right to request any proof of deposit where necessary to complete further investigation.

6.1.11. You agree, by depositing money, not to make any chargebacks, reversals or otherwise cancel any deposits that have been successfully made into your account and agree to refund and compensate us for unpaid deposits.

(6.2) Wagering and making use of the player account

6.2.1. Any stake made by you will be treated by us as an authorization to debit your account. This authorization will be successful granted that the balance on the account at the time the stake is made is greater than or equal to the requested stake amount and the funds will be in turn successfully removed from your balance accordingly.

6.2.2. You acknowledge that by placing a bet, you have checked your selections thoroughly and that they are correct and exactly represent your intended bet. Once a bet has been successfully placed, you agree that we reserve the right to not cancel this bet, and if we do it will be at our sole discretion. When placing the bet, you acknowledge that you do not already know the outcome of the event or selection you are betting on.

6.2.3. Once wagers are settled or games are completed, any amount of winnings will be automatically credited to your balance.

6.2.4. ngenge actively manages financial liabilities and risk on events and markets. Liability and exposure controls can be applied across betting markets and or across individual accounts to manage these liabilities. Furthermore, we actively monitor customer accounts as described in our privacy policy. Should your activity stand out from what we consider to be usual and expected behaviour, or if it matches certain known patterns, we may exclude you from certain promotions or from placing certain bets or certain bet amounts. Examples of unusual betting behaviour include but are not limited to:

(a) An alert from any of our trusted third-party providers or internal system or departmental flags.

(b) Placing larger than expected bets appearing on a specific outcome.

(c) Intentionally betting on moving odds or lines to take advantage of odds discrepancies.

(d) Any bets placed which mimic known patterns or behaviours of arbitrage users/systems.

(e) Betting on an event while having knowledge or information to the potential or actual outcome of an event.

(f) A substantial change in an established betting behaviour.

(g) Placing a large number of bets in a short time on one specific outcome.

(6.3) Withdrawals

6.3.1. You may withdraw your cash balance at any time, subject to any specific conditions of promotional offers you may receive throughout your play on our website. You will need to meet wagering requirements before withdrawing any bonus or winnings associated with it. More information about promotional and bonus credits can be found on our bonus rules page here and on the specific offer itself. Due to the nature of the services we provide, we are not able to cancel withdrawals for players that have been successfully processed already. Furthermore, you must place bets at least cumulatively equal to two times the amount deposited. This rule applies to each individual deposit you make. If this is not the case, the appropriate transaction fees we incur will be deducted from the withdrawal.

6.3.2. ngenge incurs fees when transactions are processed. To cover our fees, we have set a minimum withdrawal amount of 10 EUR/USD/CAD/GBP (or currency equivalent). All withdrawals will be processed back to the same payment method used to deposit onto your account (where possible). Additional payment charges may be incurred that are outside of our control. Please contact customer support if you have any questions about your withdrawal or associated fees.

6.3.3. We are entitled to determine minimum and maximum amounts to be withdrawn from a player account, at our discretion. We reserve the right to impose a limit on the winnings you generate in a 30-day rolling period of 100 000 EUR, furthermore the winnings from a single bet can be limited to 10,000 EUR at our sole discretion. Additionally, we reserve the right to limit withdrawals within this same 30-day rolling period up to 50,000 EUR or 5,000 EUR per individual transaction or 10,000 EUR per consecutive week.

6.3.4. If you wish to withdraw funds from your account and have claimed any promotional offer, it is your responsibility to make sure you have read and fully understand the general promotional terms as well as any specific terms relating to that offer. If you are uncertain about any of these terms, please contact customer support for further information. You may withdraw your cash balance at any time, as long as you have complied with the rules set out …here. If you initiate a withdrawal and you have any bonus on the account, you understand that you fully and irrevocably forfeit all bonus funds you might have. If you wish to successfully withdraw the entire balance on your account, bonus as well as cash, you need to ensure that you have met all relevant rollover and wagering requirements first.

6.3.5 ngenge must successfully verify your identity as described in section 7 below. If you have not been fully verified, you may not be able to deposit or withdraw or you may have this function limited until we are able to successfully verify your identity. If we detect any suspicious behaviour, we may ask for additional identity verification as required. We are obliged to carry out any additional verification procedures for any withdrawal or any number of withdrawals. Furthermore, if the cumulative or single withdrawal value is equal to or exceeds 2 000 EUR or any currency equivalent, we reserve the right to halt the withdrawal process until successful identity and account verification has been completed. All transactions are required to be checked in order for us to prevent money laundry or possible terrorist activity financing.

6.3.6 We strictly prohibit the transfer of funds between individual accounts. ngenge does not provide advice regarding tax and/or legal matters. Customers who wish to obtain advice regarding tax and legal matters are advised to contact appropriate advisors.

6.3.7 You are solely responsible for any applicable taxes on any prizes and/or winnings that you collect from ngenge.

6.3.8 You are strictly prohibited from utilizing ngenge and its systems to facilitate arbitrage. Where ngenge deems that you have deliberately used the systems for financial gain through arbitrage, any gains will be forfeited and deducted from your balance without warning or notification.

(7) Verification

7.1. We are required, by law, to verify all of our players identities’. We do this to comply with the requirements of our licenses, and to maintain the responsibility of actively preventing underage gambling and potential criminal activity on our platform.

7.2. Upon registration, you are required to enter your personal details. These include, but are not limited to: name, address and date of birth. This data is used by us and protected as described in our privacy policy. You warrant that the details you provide are true and accurate.

7.3. While we are conducting the verification procedure, we may restrict you from withdrawing funds from your account.

7.4. We will endeavour, where possible, to verify your account within a reasonable timeframe once you have submitted documents for us to review. In order for us to positively verify the details provided upon registration, we require the following documents:

(a) A copy of a valid photographic identification document, such as a passport or driver's license, and

(b) A copy of a recent utility bill confirming residence, such as an electricity bill, telephone bill etc. (important: the utility bill must not be older than 3 months), and

(c) Where necessary, a copy of a recent credit card / debit card / bank account statement (note: the account statement must relate to a financial method used on your account and must not be older than 3 months), and

(e) Any additional documents that might be deemed necessary.

7.6. If you cannot be verified based on the documents provided, we may have to contact you and ask you to provide further information to us directly in order to complete the process. We may ask you for a video call confirmation in order to verify your identity. Video call confirmation methods include Skype, Discord, WhatsApp video call and FaceTime. If we cannot complete the verification, we will suspend your account until you can provide us with positive proof of ownership of the account. Any balances on the account will be held until we are satisfied with the appropriate verification information.

(8) Underage gambling

8.1. As stated above, you must be at least 18 years of age, and above the legal age for gambling in the jurisdiction in which you reside to use our services. If we have reason to believe that you may be underage:

(a) Your account will be frozen, and

(b) No further gambling will be permitted until we have successfully verified your age.

8.2. We may withhold any funds in your ngenge account until your age is successfully verified. If we conduct the age verification process and you are found to be underage, we will return any deposits made on the account to the source from which they were made, having voided all wagers, winnings and/or bonuses made or earned while you were underage.

(9) Responsible gaming

9.1. We are focused on providing you with the safest and fairest environment to enjoy our services. If you, however, feel as though you are no longer in control of your gameplay or you feel like you would like more information about what methods are available for you to take control over your gameplay, please refer to our dedicated responsible gaming section here.

(10) Our rights

10.1.1. We reserve, at our sole discretion, the right to:

(a) Refuse to accept any registration or attempt to create an account on the website.

(b) To change, suspend, remove, modify, or add any game or tournament on the website.

(c) Refuse to accept any stake or wager made on our website for any reason including but not limited to:

10.1.2. Where the account holder, or people associated with the account holder directly or indirectly influence the outcome of an event.

10.1.3. Where the account holder and or people associated with the account holder are directly or indirectly avoiding the rules of ngenge.

10.1.4. Where result of an event has been directly or indirectly affected by criminal activity.

10.1.5. Where the odds of an event have significantly been changed due to a public announcement in relation to the event.

10.1.6. Where bets have been placed that would not have been accepted otherwise, but that were accepted during periods when the website has been affected by technical problems.

10.1.7. Any error, such as a technical error, force majeure or otherwise and as a result bets have been offered, placed and or accepted. We do not accept any responsibility for typing, human or palpable errors.

10.1.8. Furthermore, if a stake or wager has successfully been made and we are later made aware of any reason that would cause the need to void such a transaction, we reserve the right to do so at our sole discretion. In the event of any dispute regarding a stake or winnings, our decision will be final and binding.

(10.2) Unplayed, aborted or incomplete games

10.2.1. We are not liable for any downtime, server disruptions, lagging, or any technical or political disturbance to gameplay. Refunds may be given solely at the discretion of ngenge.

10.2.2. We shall accept no liability for any damages or losses which are deemed or alleged to have arisen out of or in connection with the website or its content; including without limitation, delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person's misuse of the site or its content or any errors or omissions in content.

10.2.3. In the event of a complete system malfunction, all wagers are void. This malfunction would need to be investigated thoroughly before any final actions can be taken.

10.2.4. In the event a game is started but aborted because of a failure of the system, we shall refund the amount wagered in the game to you by crediting it to your account or, if the account no longer exists, by paying it to you in an approved manner.

10.2.5. If there are any interruptions in play after a wager has been placed, we will endeavor to re-initiate the session which was interrupted and restore whatever state you were in at the time of this failure. We understand that there are a multitude of reasons for these interruptions including telecommunications issues, computer system failures etc. If restoring the session is not possible, we will ensure that the session is terminated and the amount that was placed by you is returned to your account.

10.2.6.
